Welcome to the SpecChem mobile application (the “Application”), provided by SpecChem (“we,” “us,” or “our”). By downloading, accessing, or using the Application, you agree to these legally binding Terms & Conditions (“Terms”). Please read them carefully before proceeding.

1. Use of the Application

This Application is intended for commercial and professional use by contractors, distributors, engineers, architects, and others in the concrete and construction industry. You agree to comply with all applicable laws while using the Application and not to use it for any unlawful or unauthorized purpose.

2. Intellectual Property

All content in the Application—including documents, data, designs, branding, images, and code—is the property of SpecChem or its content providers and is protected by U.S. and international copyright, trademark, and intellectual property laws. Unauthorized use, reproduction, or distribution is strictly prohibited.

3. User Conduct

While using the Application, you agree not to:

• Upload, transmit, or distribute malware or malicious code
• Scrape, crawl, or collect data without authorization
• Interfere with the operation or performance of the app
• Attempt to reverse engineer or decompile any app features

4. Disclaimers

The Application is provided “as is” and “as available” without warranties of any kind, either express or implied. While we strive to ensure accuracy, we make no guarantees regarding the completeness, reliability, or suitability of any information in the Application, including Technical Data Sheets (TDS) or Safety Data Sheets (SDS).

5. Limitation of Liability

To the fullest extent permitted by law, SpecChem will not be liable for any indirect, incidental, special, or consequential damages resulting from the use of or inability to use the Application, including loss of data, business interruption, or lost profits.

6. Third-Party Services

The Application may rely on or integrate services from third parties, such as:

• Google Play Services
• Google Analytics for Firebase
• Sentry
• Apple Push Notification Service

Use of these services is governed by their respective privacy policies and terms. We are not responsible for third-party practices or content.

7. Privacy

Your use of the Application is also governed by our Privacy Policy. By using the Application, you acknowledge and agree to how we handle data as outlined in that policy.

8. Termination

We reserve the right to suspend or permanently terminate your access to the Application at any time and for any reason, including but not limited to violations of these Terms, unlawful behavior, or disruptive use of the app.

9. Governing Law

These Terms are governed by the laws of the State of Missouri, without regard to its conflict of laws provisions. Any legal disputes shall be resolved in the courts located in Jackson County, Missouri.

10. Changes to These Terms

We may update these Terms periodically. Any changes will be reflected on this page along with the revised effective date. Continued use of the Application after such updates signifies your acceptance of the changes.
